Moraes arquiva inquérito contra Silveira
O ministro Alexandre de Moraes, do Supremo Tribunal Federal (STF), determinou o arquivamento do inquérito que investigava o ex-deputado Daniel Silveira por supostas violações ao uso da tornozeleira eletrônica.
O processo foi instaurado em 2021, por decisão do próprio Moraes, com base em mais de 30 alegações de descumprimento das medidas cautelares impostas a Silveira. Em 2022, o inquérito chegou a ser prorrogado por mais de 60 dias. Na época, o ministro voltou a decretar a prisão do ex-parlamentar em 24 de junho, por considerar que havia desrespeito à ordem judicial.
Segundo a decisão assinada por Moraes na última semana, o arquivamento atende a um pedido da Procuradoria-Geral da República (PGR), que argumentou não haver elementos suficientes para configurar crime. “Tendo o Ministério Público Federal requerido o arquivamento no prazo legal, não cabe ação privada subsidiária, ou a título originário, sendo essa manifestação irretratável, salvo no surgimento de novas provas”, afirmou Moraes.
A PGR justificou que a suposta violação foi solucionada com a prisão preventiva decretada em 24 de junho de 2021. “Assim, excluída a tipificação criminal do fato, o Ministério Público Federal manifesta-se pelo arquivamento dos autos”, destacou o parecer.
Defesa critica procedimento e aponta irregularidades
O advogado de Daniel Silveira, Paulo Faria, classificou o inquérito como uma “farsa” utilizada por Moraes para manter seu cliente na prisão. “Foi um inquérito aberto de ofício, por Moraes, para apurar supostas violações à tornozeleira em prisão domiciliar”, declarou Faria à revista Oeste. Segundo ele, a própria perícia da Polícia Federal comprovou que não houve violação no monitoramento eletrônico.
Situação atual de Silveira
Em 20 de abril de 2022, o STF condenou Silveira a 8 anos e 9 meses de prisão pelos crimes de ameaça ao Estado Democrático de Direito e coação no curso do processo. Apesar disso, em dezembro de 2023, Moraes autorizou a prisão domiciliar do ex-deputado. Pouco depois, na véspera do Natal, determinou sua reclusão novamente por supostos descumprimentos das medidas cautelares.
Atualmente, Silveira cumpre pena em uma colônia agrícola localizada em Magé, no estado do Rio de Janeiro.
